Take confession from them!

 

Take confession from them! (L-3246)

فَبَايِعْهُنَّ وَٱسْتَغْفِرْ لَهُنَّ ٱللَّهَ إِنَّ ٱللَّهَ غَفُورٌ رَّحِيمٌ 12b  يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ لَا تَتَوَلَّوْا۟ قَوْمًا غَضِبَ ٱللَّهُ عَلَيْهِمْ قَدْ يَئِسُوا۟ مِنَ ٱلْءَاخِرَةِ كَمَا يَئِسَ ٱلْكُفَّارُ مِنْ أَصْحَٰبِ ٱلْقُبُورِ 13

12b.  fa-baa-yi'- hunna wastagfir  lahunnAllaah.  ‘InnAllaaha  Gafuurur-Rahiim.

13.  Yaaa-‘ayyuhal-laziina  ‘aamanuu  laa  tatawallaw  qawman  gazibAllaahu  'alay-him  qad  ya-'isuu  minal-‘Aakhirati  kamaa  ya-'isal-kuffaaru  min  ‘as-haabil-qubuur.

12b.  then accept their allegiance and ask Allah to forgive them. Lo! Allah is Forgiving, Merciful.

13. O you who believe! Be not friendly with a folk with whom Allah is wroth, (a folk) who have despaired of the Hereafter as the disbelievers despair of those who are in the graves.

Baa-yi'- hunna – (Accept their pledge!), it aims: admitting before the Messenger of Allaah Almighty (grace, glory, blessings and peace be upon him) or his Viceroy to abide by the Rules and Regulations of the Religion, in return for that reward which Allaah Almighty has determined for those who follow the commandments of the Religion. It was commanded previously: Examine the emigrant believing women when they come to you. The way of examining them has been described here.

It is commanded: O Messenger (grace, glory, blessings and peace be upon him)! When believing women get ready to admit the restrictions which were mentioned in the previous verses and say verbally, “We shall neither associate someone else with Allaah Almighty, nor we shall steal, nor shall we commit unlawful sexual intercourse, nor shall we kill our children (as the people used to kill before Islam), nor shall we bring forth a slander by swearing falsely and nor we shall tell concerning the children of others that those are of mine or my husband’s children, and we shall never disobey any of your commandments, and we shall abide by your all such commandments wholeheartedly”, then you must accept their allegiance and consider that they are Muslims. Ask forgiveness for them of Allaah and have faith that Allaah Almighty is Forgiving and Merciful.

After that it is commanded: Bear in mind, do not make allies of a people with whom Allaah Almighty has become angry. They have despaired of reward in the Hereafter just as the disbelievers who do not have belief in the life on the Day of Resurrection. They do not hope that they will be brought back to life again after death. They have despaired of meeting the inhabitants of the graves. They say: There is no life after death, whosoever died, died forever.

Trial of Belief (L-3245)

وَٱتَّقُوا۟ ٱللَّهَ ٱلَّذِىٓ أَنتُم بِهِۦ مُؤْمِنُونَ 11b  يَٰٓأَيُّهَا ٱلنَّبِىُّ إِذَا جَآءَكَ ٱلْمُؤْمِنَٰتُ يُبَايِعْنَكَ عَلَىٰٓ أَن لَّا يُشْرِكْنَ بِٱللَّهِ شَيْـًٔا وَلَا يَسْرِقْنَ وَلَا يَزْنِينَ وَلَا يَقْتُلْنَ أَوْلَٰدَهُنَّ وَلَا يَأْتِينَ بِبُهْتَٰنٍ يَفْتَرِينَهُۥ بَيْنَ أَيْدِيهِنَّ وَأَرْجُلِهِنَّ وَلَا يَعْصِينَكَ فِى مَعْرُوفٍ 12a

11b.  WattaqUllaahal-laziii  ‘antum  bihii  Mu'-minuun.

12a.  Yaaa-‘ayyuhan-Nabbiyyu  ‘izaa  jaaa-'akal-Mu'-minaatu  yubaa-yi'-naka  'alaaa  ‘allaa  yushrikna  Billaahi  shay-'anw-wa  laa  yasriqna  wa  laa  yazniina  wa  laa  yaqtulna  ‘awlaada-hunna  wa  laa  ya'-tiina  bi-buhtaaniny-yaftarii-nahuu  bayna  ‘aydiihinna  wa  ‘arjuli-hinna  wa  laa  ya'-siinaka  fii  ma'-ruufin-

11b.  and keep your duty to Allah in Whom you are believers.

12a. O Prophet! If believing women come unto you, taking oath of allegiance unto you that they will ascribe no thing as partner unto Allah, and will neither steal nor commit adultery nor kill their children, nor produce any lie that they have devised between their hands and feet, nor disobey you in what is right,

Stress of equity and justice, even upon those too who disbelieve, can be understood from above mentioned commandments. It has been described that the right of a disbeliever must be paid from the Public Treasury if a Muslim is poor and unable to pay his right. What can be more justice than it? Therefore, it is commanded: Only such person can play so much fair who fears Allaah Almighty. O Muslims! You believe in Allaah Almighty, so you must do all works fearing Him and establish an example of justice in the world.

After that the way of examining the emigrant women has been described, by which their belief will be tested. It is commanded: O Messenger (grace, glory, blessings and peace be upon him)! When believing women are ready to admit verbally before you or your Caliph that, “We shall neither ascribe any partner to Allaah Almighty, nor we shall steal, nor shall we commit unlawful sexual intercourse, nor shall we kill our children (as the people used to kill before Islam), nor shall we bring forth a slander by swearing falsely and nor we shall tell concerning the children of others that those are of mine or my husband’s children, and we shall never disobey any of your commandments, and we shall abide by your all such commandments wholeheartedly”.

Education of justice (L-3244)

وَلَا تُمْسِكُوا۟ بِعِصَمِ ٱلْكَوَافِرِ وَسْـَٔلُوا۟ مَآ أَنفَقْتُمْ وَلْيَسْـَٔلُوا۟ مَآ أَنفَقُوا۟ ذَٰلِكُمْ حُكْمُ ٱللَّهِ يَحْكُمُ بَيْنَكُمْ وَٱللَّهُ عَلِيمٌ حَكِيمٌ 10b  وَإِن فَاتَكُمْ شَىْءٌ مِّنْ أَزْوَٰجِكُمْ إِلَى ٱلْكُفَّارِ فَعَاقَبْتُمْ فَـَٔاتُوا۟ ٱلَّذِينَ ذَهَبَتْ أَزْوَٰجُهُم مِّثْلَ مَآ أَنفَقُوا۟ 11a

10b. Wa  laa  tumsikuu  bi-'isamil-kawaafiri  was-'aluu  maaa  ‘anfaqtum  wal-yas-'aluu  maaa  ‘anfaquu. ; Zaalikum  HukmUllaah.  Yahkumu  baynakum.  Wallaahu  'Aliimun- Hakiim.

11a.  Wa  ‘in  faatakum  shaiy-'um-min  ‘azwaajikum  ‘ilal-kuffaari  fa-'aaqabtum  fa-‘aatul-laziina  zahabat  ‘azwaajuhum-misla  maaa  ‘anfaquu.

10b.  And hold not to the ties of disbelieving women; and ask for (the return of) that which you have spent; and let them (the disbelievers) ask for that which they have spent. That is the judgment of Allah. He judges between you. Allah is Knower, Wise.

11a. And if any of your wives have gone from you unto the disbelievers and afterward you have your turn (of triumph), then give unto those whose wives have gone the like of that which they have spent,

In the previous verse, it was commanded that the emigrant Muslim women must not be returned to Makkah. The people of Makkah did not argue on it and the Peace Treaty remained firm according to practice. In this verse, there is commandment concerning such women who were in the nuptial of Muslims, but did not emigrate to Madinah along with their husbands, and lived in Makkah. Nuptial of such woman with a Muslim man was broken. Then the disbelieving man who marries her, have to return the money which the Muslim man paid to his previous wife i.e. a dower etc. as the Muslim man will pay to the disbelieving man which he spent on his wife, the woman who embraced Islam, emigrated to Madinah and a Muslim man married her.

The Muslims got ready to act upon this commandment, but the disbelievers did not accept to pay the money. Then it was commanded: The Muslim woman who went to disbelievers or remained among them, and the disbelievers do not return the money spent by the Muslims on their wives, then you also should not return the money of that woman who embraced Islam and came to you. But you must give that amount to such Muslim whose wife left Islam and went back to Makkah. If any amount remains in balance; then you must return it to the disbeliever.

Don’t send female believers to disbelievers (L-3243)

يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓا۟ إِذَا جَآءَكُمُ ٱلْمُؤْمِنَٰتُ مُهَٰجِرَٰتٍ فَٱمْتَحِنُوهُنَّ ٱللَّهُ أَعْلَمُ بِإِيمَٰنِهِنَّ فَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَٰتٍ فَلَا تَرْجِعُوهُنَّ إِلَى ٱلْكُفَّارِ لَا هُنَّ حِلٌّ لَّهُمْ وَلَا هُمْ يَحِلُّونَ لَهُنَّ وَءَاتُوهُم مَّآ أَنفَقُوا۟ وَلَا جُنَاحَ عَلَيْكُمْ أَن تَنكِحُوهُنَّ إِذَآ ءَاتَيْتُمُوهُنَّ أُجُورَهُنَّ 10a 

10a.  Yaaa-‘ayyuhal-laziina  ‘aamanuu  ‘izaa  jaaa-'akumul- Mu'-minaatu  Muhaajiraatin-  famta-hinuu- hunn.  ‘Allaahu  ‘A’-lamu  bi-‘iimaani-hinn.  Fa-‘in  'alimtu-muuhunna  Mu'-minaatin  falaa  tarji-'uuhunna  ‘ilal- kuffaar.  Laa  hunna  hillul-lahum  wa  laa  hum  yahilluuna  lahunn.  Wa  ‘aatuuhum-maaa  ‘anfaquu.  Wa  laa  junaaha  'alatkum  ‘an  tankihuuhunna  ‘izaaa  ‘aatay-tumuuhunna  ‘ujuurahunn.

10a. O you who believe! When believing women come unto you as fugitives, examine them. Allah is Best Aware of their faith. Then, if you know them for true believers, send them not back unto the disbelievers. They are not lawful for them (the disbelievers), nor are they (the disbelievers) lawful for them. And give them (the disbelievers) that which they have spent (upon them). And it is no sin for you to marry such women when you have given them their dues.

It was decided in this verse: The women are not included in that term of the Peace Treaty of Hudaybiyyah, in which it was compromised that the man from Makkah who would embrace Islam and go to Madinah, would be returned to Makkah. If any woman embraces Islam and emigrates to Madinah, her nuptial with the idolater husband will be broken. So she must not be returned to Makkah.

It is commanded: O you, who have believed, when the believing women come to you from Makkah as emigrants, Allaah Almighty knows their condition of belief, but you also must examine them apparently. And if they promise to abide by some commandments (which will be discussed later), then it will be known that they have emigrated for the cause of Islam, not for any worldly or sensual reason, then you must not return them to the disbelievers; because now neither they are lawful wives for the disbelievers, and nor the disbelieving men are lawful husbands for them. Now you must give the disbelievers what they have spent on their previous wives; that is to say; “a dower – the money or its value incumbent on the husband”. After that if any Muslim man desires to wed that woman, he can marry her after paying the dower, and this dower will be determined with effect from the beginning according to circumstances.
