Education of justice (L-3244)

وَلَا تُمْسِكُوا۟ بِعِصَمِ ٱلْكَوَافِرِ وَسْـَٔلُوا۟ مَآ أَنفَقْتُمْ وَلْيَسْـَٔلُوا۟ مَآ أَنفَقُوا۟ ذَٰلِكُمْ حُكْمُ ٱللَّهِ يَحْكُمُ بَيْنَكُمْ وَٱللَّهُ عَلِيمٌ حَكِيمٌ 10b وَإِن فَاتَكُمْ شَىْءٌ مِّنْ أَزْوَٰجِكُمْ إِلَى ٱلْكُفَّارِ فَعَاقَبْتُمْ فَـَٔاتُوا۟ ٱلَّذِينَ ذَهَبَتْ أَزْوَٰجُهُم مِّثْلَ مَآ أَنفَقُوا۟ 11a |

10b. Wa laa tumsikuu bi-'isamil-kawaafiri was-'aluu maaa ‘anfaqtum wal-yas-'aluu maaa ‘anfaquu. ; Zaalikum HukmUllaah. Yahkumu baynakum. Wallaahu 'Aliimun- Hakiim. 11a. Wa
‘in faatakum shaiy-'um-min ‘azwaajikum
‘ilal-kuffaari
fa-'aaqabtum
fa-‘aatul-laziina zahabat ‘azwaajuhum-misla maaa
‘anfaquu. |

10b. And hold not to the ties of disbelieving
women; and ask for (the return of) that which you have spent; and let them
(the disbelievers) ask for that which they have spent. That is the judgment
of Allah. He judges between you. Allah is Knower, Wise. 11a. And
if any of your wives have gone from you unto the disbelievers and afterward you
have your turn (of triumph), then give unto those whose wives have gone the
like of that which they have spent, |
In the previous verse, it was commanded that the emigrant Muslim women must not be returned to Makkah. The people of Makkah did not argue on it and the Peace Treaty remained firm according to practice. In this verse, there is commandment concerning such women who were in the nuptial of Muslims, but did not emigrate to Madinah along with their husbands, and lived in Makkah. Nuptial of such woman with a Muslim man was broken. Then the disbelieving man who marries her, have to return the money which the Muslim man paid to his previous wife i.e. a dower etc. as the Muslim man will pay to the disbelieving man which he spent on his wife, the woman who embraced Islam, emigrated to Madinah and a Muslim man married her.
The Muslims got ready to act upon this commandment, but the
disbelievers did not accept to pay the money. Then it was commanded: The Muslim
woman who went to disbelievers or remained among them, and the disbelievers do
not return the money spent by the Muslims on their wives, then you also should
not return the money of that woman who embraced Islam and came to you. But you
must give that amount to such Muslim whose wife left Islam and went back to Makkah.
If any amount remains in balance; then you must return it to the disbeliever.
