Don’t send female believers to disbelievers (L-3243)

يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓا۟ إِذَا جَآءَكُمُ ٱلْمُؤْمِنَٰتُ مُهَٰجِرَٰتٍ فَٱمْتَحِنُوهُنَّ ٱللَّهُ أَعْلَمُ بِإِيمَٰنِهِنَّ فَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَٰتٍ فَلَا تَرْجِعُوهُنَّ إِلَى ٱلْكُفَّارِ لَا هُنَّ حِلٌّ لَّهُمْ وَلَا هُمْ يَحِلُّونَ لَهُنَّ وَءَاتُوهُم مَّآ أَنفَقُوا۟ وَلَا جُنَاحَ عَلَيْكُمْ أَن تَنكِحُوهُنَّ إِذَآ ءَاتَيْتُمُوهُنَّ أُجُورَهُنَّ 10a

10a. Yaaa-‘ayyuhal-laziina ‘aamanuu
‘izaa jaaa-'akumul- Mu'-minaatu Muhaajiraatin- famta-hinuu- hunn. ‘Allaahu
‘A’-lamu bi-‘iimaani-hinn. Fa-‘in
'alimtu-muuhunna
Mu'-minaatin falaa tarji-'uuhunna ‘ilal- kuffaar. Laa
hunna hillul-lahum wa
laa hum yahilluuna
lahunn. Wa ‘aatuuhum-maaa ‘anfaquu.
Wa laa junaaha
'alatkum ‘an tankihuuhunna ‘izaaa
‘aatay-tumuuhunna ‘ujuurahunn. |

10a. O
you who believe! When believing women come unto you as fugitives, examine
them. Allah is Best Aware of their faith. Then, if you know them for true
believers, send them not back unto the disbelievers. They are not lawful for
them (the disbelievers), nor are they (the disbelievers) lawful for them. And
give them (the disbelievers) that which they have spent (upon them). And it
is no sin for you to marry such women when you have given them their dues. |
It was decided in this verse: The women are not included in that term of the Peace Treaty of Hudaybiyyah, in which it was compromised that the man from Makkah who would embrace Islam and go to Madinah, would be returned to Makkah. If any woman embraces Islam and emigrates to Madinah, her nuptial with the idolater husband will be broken. So she must not be returned to Makkah.
It is commanded: O you, who have
believed, when the believing women come to you from Makkah as emigrants,
Allaah Almighty knows their condition of belief, but you also must
examine them apparently. And if they promise to abide by some commandments
(which will be discussed later), then it will be known that they have emigrated
for the cause of Islam, not for any worldly or sensual reason, then you must
not return them to the disbelievers; because now neither they are lawful wives
for the disbelievers, and nor the disbelieving men are lawful husbands for
them. Now you must give the disbelievers what they have spent on their previous
wives; that is to say; “a dower – the money or its value incumbent on the
husband”. After that if any Muslim man desires to wed that woman, he can marry
her after paying the dower, and this dower will be determined with effect from
the beginning according to circumstances.
