The husband must not expel his wife out of his house after divorcing. However if she commits a clear immorality then there is no restriction. The women themselves too should not go out of the houses. The divorce must be given in intervals according to rule.
Divorce your wife at first during purity as it has been described earlier. You can return to your wife before ending of one month or after passing of the menses period. If you desire to leave your wife then you must divorce her second time. Even after the second divorce, before ending of the next month or after next monthly menses, you are authorized to incline to your wife. But if that period also has passed and you have divorced her third time, then she has gone out of your nuptial. Then you cannot return to her. It has been explained in Chapter Two (Suratul-Baqarah).
After that it is commanded: Allaah Almighty has set limits of every work for you. Do whatever you desire to do but in the prescribed limits. The person, who does not care and transgresses the limits of Allaah; has certainly wronged himself. You are being taught the way of divorcing in intervals, so that it may happen that you change your opinion, husband and wife may avail a chance of reconciliation within three months. After three months or menses tenures, this facility is over.
Usually the people use the word “Divorce”
without thinking and then they are entangled in confusion and distraction. Only
the expounders of Islamic Law can judge such matters that what must be done.
Even then every individual must have some information about the “Divorce”.
Therefore, main hints have been described here, which are according to Hanfii
Sect. As soon as the husband says, “I divorced”, it happened, whether he said
for laughing, carelessly or ignorantly. So everyone must be very careful in
this matter. Think before you speak! Up to two divorces, husband and wife can
reconcile, but after third divorce the wife has become unlawful, until she
marries someone else; he divorces or dies, then she can wed the first husband
again. If the husband divorced one time, but entire waiting period passed, then
she has been divorced permanently. During the waiting period, it is
responsibility of the husband that he should provide her all required things
including food.
