Introduction - “Divorce” (L-3278)

Chapter ’AT-TALAAQ – (Divorce) - 65

According to order, this is sixty-fifth Chapter of Holy Qur’an, which was revealed in Madinah during 6th year AH. It has two Sections. Chapter Two (Suratul-Baqarah) was revealed before this Chapter, in which commandments concerning the divorce were described. In this Chapter, suitable time and occasions of divorce have been explained, so that husband’s authority of divorcing may not be used for provoking and molesting the wife. Divorcing is not good. It should neither be used for punishing and nor be taken as a play.

Therefore it has been described: When you put your wife away, put her away for her legal period so that the waiting period may be reckoned without decreasing or increasing of the days. The both (husband and wife) must keep in mind carefully the days of the term (during the term of probation incumbent upon her in consequence of a dissolution of marriage either by divorce or by the death of her husband, after divorce the period is 3 months, and after death of her husband is 4 months and 10 days), so that there may not be any error in counting of the days and for escaping from any bad conclusion. So the best time of divorcing is after purity (from menses) when the husband has not committed sexual intercourse with his wife so far, because waiting period of the term is three menstruations. If husband divorces during the period of menses, that menstruation period will not be counted, but next three time’s menstruations will be counted and the waiting period will become long. And if he has touched his wife during the purity period, then it will not be possible to know that the term will be finished after three times menstruation or after the pregnancy, because there is possibility of pregnancy.

Secondly, you must not expel your wife from her house immediately after divorcing. Moreover, the woman too must not leave her house during waiting period. However if she commits open immorality or you are feeling trouble every time due to quarrels, then she can be expelled.

Thirdly, it is understood that all three divorces must not be given at a time, but in every month there must be only one divorce, so that they may have chance of reconciliation. Think before ending of the entire term, whether you will retain her or leave. You must not put her in trouble in any condition. Such are the limits imposed by Allaah Almighty, and you must fear Him. In this form He will help you.

After that, there are instructions about the pregnant divorced and minor girls. Let them breastfeed to the baby after giving birth if you desire, and pay them suitable substitution of giving suck. If you may not content her to give suck, then you must arrange for any other breastfeeding woman. You must provide facilities to the women during the term.

Then it is commanded: Abide by the Religious Laws of Islam and accomplish the rights of the women, otherwise you can be punished also due to transgression of Allaah's limits, as the disobedient before you were punished. Rules and Regulations of Islam have been explained by Holy Qur’an and the Messenger (grace, glory, blessings and peace be upon him), so that you may come out from the darkness of ignorance; in the light of knowledge. Reward of this obedience will be Paradise for you. Know the Creator of the entire universe and obey Him.
